1. What a plan includes
Each plan includes what its page lists at the time you sign up: the hosting plans, the care plans and the growth plans. Hosting runs on Google Cloud in Sydney. We do not promise a set uptime percentage; we fix problems as quickly as we can and tell you when something is wrong.
2. Billing
Monthly plans are charged each month and run until you cancel. Yearly plans are paid a year ahead and renew each year unless you cancel before the renewal date. Growth plans are monthly subscriptions paid by card. All prices include GST. If we change a plan's price, we tell you by email at least 30 days before it applies to you.
3. Backups
We take a backup of every site each day, keep it for 30 days and restore one on request. Backups are how we recover from mistakes and failures, but no backup system is perfect. Keep your own copy of anything you cannot afford to lose, such as orders, bookings and important documents.
4. Your account and your domain
Domains we register for you are registered in your name or your business's name. You can ask for the transfer code at any time from your account. Keep the email address on your account current, since logins, renewal notices and invoices go there.
5. Leaving
You can cancel at any time, by email or from the billing page in your account. We hand over a full copy of your site, its database and your email on request. We also help point your domain to its new home. See refunds and cancellations for what is refunded.
6. Late payment and suspension
If a payment is 14 days overdue, we email you before doing anything. If it is still unpaid 7 days after that, we may suspend the site until it is paid. If a plan stays unpaid for 60 days, we may remove the site; we email you a copy of it first.
7. Acceptable use
Our servers are shared with other businesses, so these rules keep everyone safe. You must not use a site, mailbox or account we host to:
- publish anything illegal in Australia or content that infringes someone else's copyright or trade marks;
- host or spread malware, phishing pages or anything designed to trick people or steal their details;
- send spam or bulk marketing email (use a proper email marketing service for newsletters);
- mine cryptocurrency, run scanners or attacks against other systems or use far more server resources than a normal business website;
- resell our hosting without our written agreement.
If we receive a credible complaint or find something that breaks these rules, we may take the content down or suspend the site to stop harm. We then tell you what happened and why. We cooperate with lawful requests from authorities.
8. Security
We keep the server, the software we manage and the certificates up to date. You are responsible for keeping your own logins private and for the content you add to your site. If you think a login has been exposed, email us straight away.
9. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing here limits them. Beyond them, we are not responsible for indirect losses such as lost profits. Our total responsibility is limited to the fees you paid for the plan in the previous 12 months, as far as the law allows.
10. Everything else
We may update these terms with at least 30 days' notice by email. These terms are governed by Australian law, including the law of the state or territory where we are based.
