Website build terms Draft

How a website build with us works, in plain English. These terms are in draft while they are reviewed. The version linked from your written quote is the one that applies to your build.

1. The quote is the scope

Every build starts from a quote: the one you build and pay for on the websites page or a written quote we send by email. It sets out the package, the number of pages, the add-ons and the hosting plan, with the price inc GST. That quote is what we build. Anything outside it is quoted separately, in writing, before we do it. Prices on this website are listed prices; the written quote is the figure that counts.

2. Paying for the build

You pay the build price in full when you book, by card on the websites page or by the payment link in a written quote. We start once it is paid and send your homepage demo within 7 days of payment, provided we have what we asked you for (see section 4). Stripe emails a receipt and an invoice.

3. The demo and revisions

The homepage demo shows the design, the layout and the tone before the rest of the site is built. You can approve it or ask for changes. Two rounds of changes to the demo are included, then two rounds of changes to the finished site before launch. Further rounds and changes beyond the quote are charged at $100 an hour including GST and agreed with you first.

4. Your content

You supply the words, photos, logo and business details the site needs, unless the quote includes copywriting or content moves. You confirm you own them or have permission to use them. If a delay on your side holds the build up, the dates move with it.

If we are waiting on you for 30 days, we pause the project and let you know. If it is still paused 60 days after that, we may close it. We then keep payment for the work done and refund the rest of the build price.

5. Going live

When the site is finished and you have approved it, it goes live. Hosting starts on launch day and is charged to the card you paid with, monthly or yearly as chosen in the quote.

6. Hosting

The sites we build run on one of our hosting plans, except Shopify shops, which Shopify hosts. After launch you are free to move the site elsewhere at any time. We hand over a full copy of the site and its content. Your domain stays in your name. The hosting and care terms cover the plans.

7. Who owns the site

Once the build is paid in full, the design, the pages and the content we made for you are yours. Until then we may keep the site offline or on a demo address. Themes, plugins, fonts, apps and other software from third parties stay under their own licences; where a licence is needed, it is in your name or covered by your hosting plan. We may keep a copy of the design in our records and show it as our work, unless you ask us not to.

8. Ending a build early

You can end a build at any time by email. What is refunded is set out in refunds and cancellations. We can end a build if the terms are breached, if a payment is more than 30 days overdue or if the content you supply is unlawful. Either way, you pay only for work done and receive what has been made so far.

9. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. Beyond them, we are not responsible for indirect losses such as lost profits. Our total responsibility for a build is limited to the amount you paid for it, as far as the law allows.

10. Everything else

We may update these terms for future builds; a build already under way stays on the terms in its quote. These terms are governed by Australian law, including the law of the state or territory where we are based.
